1. The Survey Fee for Groundwater Surveys (alongwith Transportation and Miscellaneous Charges in case of Out-station Surveys) must be paid by the Client to Mr. Michael J. Davis, the Water Diviner (hereinafter for the sake of brevity referred to as "the Water Diviner"), In Full, IN ADVANCE (i.e., Before the Survey), either in Cash or by Speedpost Money Order at his Deolali residence. All communications, written or verbal, correspondence and documents must be in ENGLISH only, please.
   
   
2. The Client shall provide the Water Diviner with suitable 4-wheeler Transport from his Residence in Deolali to the Site to be Surveyed, and back to his Residence in case of local Surveys. In case of Out-station Surveys, the Client must first confirm the mutually convenient date of the Survey with the Water Diviner, and, accordingly as per his directions arrange and send him the Return Air/Rail (A/C class) Tickets / PTA, with confirmed bookings, and, where required pre-paid Hotel Vouchers, Visas and Permits, and Miscellaneous Charges along with a signed covering / requisition letter, by Courier, so as to be received by the Water Diviner well in advance of the date of departure on the out-ward leg of the journey from Deolali.
   
   
3. In case of Out-station Surveys, the Client shall meet the Water Diviner at the Airport/Railway Station and transport him to the Site to be surveyed, and back to the Airport/Railway Station after the completion of the Survey. In all cases, the Client or his / her authorised representative must be present throughout the Survey.
   
   

4. All Groundwater Surveys are done on a 'Best Efforts' basis. There will be No Refund under any circumstances, please note.The Survey Fee DOES NOT INCLUDE any Guarantee from the Water Diviner that the Client will strike water when the Point is drilled. The Water Diviner will not be liable in any way in case of failure to strike water for any reason.

5. By using this Web-Site, the information provided on this Web-Site or the personal services of the Water Diviner, you agree to be legally bound by these terms, which shall take effect immediately. If you do not agree to be legally bound by all these terms please do not access and/or use this Web-Site or the personal Services of the Water Diviner.

6. The Water Diviner reserves the right to and may change these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made by the Water Diviner. Your continued use of the services mentioned on this Web-Site after changes are posted means you agree to be legally bound by these terms as updated and/or amended.

In case any difference arises between the Water Diviner and the Client touching or relating to the contract of personal services for Water Divining i.e., Groundwater Surveys and/or Map Dowsing, and/or any of the terms and conditions pertaining to the same, mentioned on this Web-Site, and/or to the interpretation of any matter or thing arising directly or indirectly from or under the said contract of personal services, the interpretation and the decision of the Water Diviner shall be final.
